1. AGREEMENT AND DEFINITIONS
1.1 Agreement Overview: Welcome to our Terms of Use! This document forms a legal agreement (“Agreement”) between you (“User”) and Kostiantyn Baturin / Baturintech (“Provider”) governing the use of mobile applications developed by Baturintech. By downloading or using the application, you agree to these terms. 1.2 Terms and Definitions:
Effective Date: The date you start using the application. User Content: Photos, notes, or any data created or uploaded by the User in the app. Mobile Application: The mobile software developed by Baturintech, including Where’s My Car: Tracker. Device: Your smartphone, tablet, or any compatible device. Trial Period: Free trial period with full or limited access to the app’s features. Services: All features and functions provided by the application. Subscription: Access to premium services on a paid basis with auto-renewal. Subscription Term: The duration of the subscription plan. Subscription Fees: Fees charged for the subscription services. Free Term: A limited free access period for testing the app. Free Services: Functions available without payment. Tariffs: Different subscription plans with varying access levels. 2. SERVICES The Provider grants you a personal, non-transferable license to use the mobile application. Services may include saving parking locations, notifications, photo attachments, in-app purchases, and more. Free Services are available during the Free Term. The Provider may modify or limit the functionality at any time. 3. AUTHORIZATION To use the app, you must: Download the application from an official app store. Agree to the Privacy Policy. Ensure your account is secure. Consent to the processing of your data in accordance with our Privacy Policy.
4. CONTENT You retain ownership of your content (e.g., parking data, photos), but you grant the Provider a non-exclusive license to store and process it to operate the app. The Provider is not liable for lost User Content. 5. USER RESTRICTIONS You agree not to: Copy or reverse engineer the app. Use the app for illegal purposes. Upload harmful or unlawful content.
6. OBLIGATIONS Provider’s Obligations: Provide the services with reasonable care and skill. Maintain app performance to the best of its ability. User’s Obligations: Pay Subscription Fees where applicable. Protect your account data. Use the app in compliance with applicable laws.
7. TERM AND TERMINATION This Agreement starts from the Effective Date and remains in force until terminated by you or the Provider. The Provider may suspend or terminate your access in case of violations or for any reason. 8. FEES AND PAYMENT Some services require payment. Subscription Fees will be charged based on your selected plan. All in-app purchases are handled through the App Store and subject to its terms. 9. LIABILITY The application is provided “as is.” The Provider disclaims all warranties and is not liable for: User-generated content. Service interruptions. Indirect or consequential damages. Users agree to indemnify the Provider against any claims related to misuse of the app. 10. GOVERNING LAW These Terms are governed by the laws of the State of California, USA, unless otherwise required by local laws. 11. FINAL PROVISIONS Both parties act as independent contractors. All personal data is processed in accordance with the Privacy Policy. The Provider may suspend services for updates or maintenance.
